R&B singer Nivea arrested for DUI after hitting a tree in northwest Atlanta

R&B; singer Nivea was arrested in Atlanta on Sunday, charged with driving under the influence after hitting a downed tree.

Atlanta police said the singer, whose name on the police report was Nivea Nash, had bloodshot eyes and smelled of alcohol when they arrived at the accident scene in northwest Atlanta. A child was in the vehicle but was not injured. Nivea, however, complained of head and neck injuries and was taken to a hospital, where she was later arrested and taken to Atlanta city jail.

Nivea posted a cash bond of $2,876.50 on Sunday and was released, a jail official said Tuesday.  A July 13 court appearance has been scheduled.

On Twitter, the singer denied she was drinking and suggested the “media and law” were being used against her.

“Its just unfortunate how the Media & Law can be used against you when you don’t know enough about the way they work,” Nivea posted. “I WAS NOT DRINKING AND DRIVING, the accident was Not due to me being intoxicated. Just wanted to clear that.”

Police, however, say otherwise.

Nivea told officers she did not see the yellow tape and traffic cones warning motorists about the tree on Marietta Road before she hit it with her cream 2006 Mercedes 350 sedan at 1:30 a.m. Sunday. The tree had been down since storms swept through metro Atlanta on Saturday.

The incident report says an Atlanta firefighter was first on the scene, and Nivea told the firefighter she had three alcoholic beverages at an earlier event but didn’t describe the event. TMZ reported the event was a wedding reception for Toya Carter, the ex-wife of Lil Wayne and mother of one of the rapper’s four children. Nivea is also the mother of one of  Lil Wayne’s children, and TMZ reported Lauren London, another mother of the rapper’s children, was also at the reception.

When an officer arrived at the accident, he said, “I could smell a strong, noticeable odor of an alcoholic beverage on Miss Nash, and also noticed she had a bloodshot, glassy eye appearance.”

Nivea complained of head and neck injuries and was taken to Atlanta Medical Center, where she was later arrested and charged. In addition to the charge of “driving under the influence less safe,” she was charged with reckless driving and driving too fast for conditions. The “less safe” reference on the DUI charge is the reference given when a suspect does not take the field sobriety test and their blood alcohol level cannot be determined.

The child in the car was turned over to Nivea’s boyfriend at the singer’s request.

In addition to having a son with Lil Wayne, Nivea also has a daughter with R&B; singer and producer Terius “The-Dream” Nash, with whom she was married.

In March, Lil Wayne, also known as Dwayne Michael Carter, Jr., told a radio interviewer that he planned to get out of the spotlight in a few years to become “a full-time dad.” “I’m gone at, like, 35. I’m serious,” the 30-year-old said at the time. “I have four kids. I would feel selfish still going to the studio when it’s such a vital point in their lives.”
